MINUTES OF THE MEETING OF THE MAYOR
AND CITY COUNCIL
OF THE CITY OF EAST MOLINE,
COUNTY OF ROCK ISLAND, STATE OF ILLINOIS,

AT 06:30 PM ON 12/01/2003

PLEDGE

Mayor Moreno led the City Council and all those present in the Pledge of Allegiance To The Flag.

ROLL CALL

Mayor Moreno called the meeting to order and directed Deputy City Clerk Kathryn VenHuizen, to call the roll, and the following Aldermen were present: Helen Heiland, Luis Puentes, Luis Moreno, Carol Doose, Rick Meredith, Gary Kelley and Crotis Teague.

AMENDMENTS TO THE AGENDA

City Attorney Bill Phares added an item under City Attorney, Other, titled "Class Action Lawsuit"

CONSENT AGENDA

A) Approval of the City Council Minutes of November 17, 2003

B) Approval of Committee Of The Whole Minutes of November 17, 2003

C) Approval of Salaries in the amount of $311,532.55

D) Approval of Bills in the amount of $1,580,775.32

E) Approval to hire a replacement officer for a vacant position due to a resignation

A motion was made by Alderman Moreno, seconded by Alderman Meredith, to approve the Consent Agenda as presented. Upon roll call the following voted in favor: Heiland, Puentes, Moreno, Doose, Meredith, Kelley, and Teague.

REPORT BY MAYOR Mayor Moreno reminded everyone the 2nd Annual Lighting contest is underway. The deadline is December 26th at 5 pm with the winner being announced on December 29th.

Mayor Moreno informed the council that on Dec. 6 at 6:30 pm two local radio stations will be airing a live reading of Charles Dickens, A Christmas Carol. The Mayor will be playing the part of a young Scrooge.

CITY ATTORNEY

ORDINANCE 03-38: An Ordinance Authorizing The Filing Of A Petition For Demolition Of The Garage Located At 535 16th Avenue, East Moline, Illinois.

A motion was made by Alderman Kelley, seconded by Alderman Meredith, to waive the reading of Ordinance 03-38. Upon roll call the following voted in favor: Heiland, Puentes, Moreno, Doose, Meredith, Kelley, and Teague. Motion carried.

A motion was made by Alderman Kelley, seconded by Alderman Teague, to adopt Ordinance 03-38 as presented. Upon roll call the following voted in favor: Heiland, Puentes, Moreno, Doose, Meredith, Kelley, and Teague. Motion carried.

RESOLUTION 03-32: Resolution Of The City Council Of The City Of East Moline, Illinois, Authorizing Acceptance Of A Federal Grant As Part Of The "Assistance To Firefighters Program".

A motion was made by Alderman Puentes, seconded by Alderman Doose, to adopt Resolution 03-32 as presented. Upon roll call the following voted in favor: Heiland, Puentes, Moreno, Doose, Meredith, Kelley, and Teague. Motion carried.

RESOLUTION 03-33 A Resolution Of The City Council Of The City Of East Moline, Illinois, Authorizing Execution Of An Environmental Clean-Up, Remediation And Hold Harmless Agreement Between The City Of East Moline, And James Oscar Ellis.

A motion was made by Alderman Meredith, seconded by Alderman Moreno, to adopt Resolution 03-33 as presented. Upon roll call the following voted in favor: Heiland, Puentes, Moreno, Doose, Meredith, Kelley, and Teague. Motion carried.

RESOLUTION 03-34: A Resolution Of The City Council Of The City Of East Moline, Illinois, Authorizing Execution Of An Agreement Between Ehlers And Associates And The City Of East Moline, Illinois, To Develop An Eligibility Plan And Redevelopment Plan To Increase The Area Of The Quarter TIF.

A motion was made by Alderman Teague, seconded by Alderman Doose, to adopt Resolution 03-34 as presented. Upon roll call the following voted in favor: Heiland, Puentes, Moreno, Doose, Meredith, Kelley, and Teague. Motion carried.

RESOLUTION 03-35: A Resolution Of The City Council Of The City Of East Moline, Illinois, Extending The Towing Agreement With Grisham's 24 Hour Towing Service, Inc., For Towing Services For The City Of East Moline.

A motion was made by Alderman Meredith, seconded by Alderman Moreno, to adopt Resolution 03-35 as presented. Upon roll call the following voted in favor: Heiland, Puentes, Moreno, Doose, Meredith, Kelley, and Teague. Motion carried.

OTHER:

Discussion regarding the Rural Fire Protection District

Chief DeFrance and Mr. Phares have been working with the Rural Fire Protection District. The district needs 3 new trustees. Chief DeFrance distributed to the members the residence that live within that district and asked that the alderman mark anyone they knew who may be interested in being a trustee and he will contact them. The final appointment is made by the Rock Island County Chair.

Discussion regarding a Class Action Lawsuit filed against all Municipalities in the State of Illinois City Attorney Phares informed the committee that the City is listed in a class action lawsuit regarding the infrastructure tax on all phone companies, including cell phone companies.

The Cities of Rock Island and Moline have decided to opt out of the class action lawsuit and negotiate a settlement on their own. Mr. Phares informed the committee he believes this would be the best avenue for the City to follow.

A motion was made by Alderman Meredith, seconded by Alderman Doose, to have the City of East Moline opt out of the class action lawsuit and negotiation a settlement on our own. Upon roll call the following voted in favor: Heiland, Puentes, Moreno, Doose, Meredith, Kelley and Teague. Motion carried.

COMMITTEE -OF-THE-WHOLE (Alderman Moreno)

Alderman Doose reported that all items have been discussed.

CITY STAFF COMMUNICATIONS

Each Department Head was given the opportunity to inform the City Council and all those present of events going on in their Departments.

Mayor: Mr. Verdick is on vacation and Mr. Willemarck was unable to attend

Keehner: Monarch Supermarket opened last Wednesday, encouraged everyone to stop in

Piatt: Discussed the Phonebook situation. The lab number is going to be put into a bank of numbers that gives the caller a listing of city offices.

Heiland: Encouraged everyone to attend the meetings at the Mark tomorrow from 4 - 7 pm on the new bridge.

FIVE-MINUTE AUDIENCE PARTICIPATION Mayor Moreno gave member of the audience the opportunity to address the City Council.

Mr. Taylor, 1915 3 Y Avenue inquired as to whether or not the City is still picking up yard waste. Alderman Kelley informed him that the City is no longer doing a regular pick up every week but if someone has yard waste they can call the garage for a pick up.
