AND CITY COUNCIL
OF THE CITY OF EAST MOLINE,
COUNTY OF ROCK ISLAND, STATE OF ILLINOIS,

AT 06:30 PM ON 11/15/2004

PLEDGE
Mayor Jose Moreno led the City Council and all those present in the Pledge of Allegiance To The Flag

ROLL CALL
Mayor Moreno called the meeting to order and directed City Clerk Arletta Holmes, to call the roll, and the following Aldermen were present: Helen Heiland, Luis Puentes, Luis Moreno, Carol Doose, Rick Meredith, and Crotis Teague. Mayor Moreno stated Alderman Kelley informed him he would be a little late.

CITY CLERK’S REPORT
Clerk Holmes reported the Awards Dinner held on Thursday, November 4, 2004 at Quad City Downs, honoring the Citizen of the Year, Denny Jacobs Public Service Award, and the Rotarian of the Year. It was very nice 122 guest were in attendance and thanks to all who supported this event. Filing dated for Petitions will begin December 6th thru December 13th. The Clerk’s Office will be opened at 6:00a.m. on December 6th to Notarize any Petitions prior to filing time beginning at 7:00a.m.

CONSENT AGENDA
A) Approval of the City Council Minutes of November 1, 2004
B) Approval of the Committee of the Whole Minutes of November 1, 2004
C) Approval of Salaries in the amount of $302,580.44
D) Approval of Bills in the amount of $612,711.20
E) Approval for the John Deere Collection Center to conduct tractor rides through the City on
June 30, 2005.
F) Approval to purchase 2 snow plows from low bidder Koenig Body in the amount of $5,186.


A motion was made by Alderman Doose, seconded by Alderman Puentes, to approve the Consent Agenda as presented. Upon roll call the following voted in favor: Puentes, Moreno, Meredith, Doose, Meredith, Teague and Heiland. Motion Carried.

REPORT BY MAYOR
Mayor Moreno read a letter from Terri Van Dyke of Human Resources, reporting that our Untied Way Campaign was a success. The City of East Moline has raised $5,416, which was beyond our monetary goal. Thanks to all who participated.

PROCLAMATION
Mayor Moreno presented Ms. Bernice Fritz, a proclamation, proclaiming November 15, 2004 as Bee Fritz Day in the City of East Moline. It is fitting that we honor Ms. Fritz and take this opportunity to remind us of the profound debt of gratitude we owe the generations of older Americans whose hard work, courage, faith, sacrifice and patriotism help make our Nation great. Ms. Fritz addressed the City Council expressing her sincere thanks and appreciation for the honor.

Alderman Kelley arrives at 6:45p.m.

GEM AWARD
Mayor Moreno presented Darrell Bush with the Great East Moliner Award, acknowledging him as a successful National Award Winning Wildlife Artist. Mr. Bush expresses his thanks to the Mayor and CityCouncil for this award. Mr. Bush will be displaying his artwork this weekend at Watch Tower Lodge in Black Hawk State Historic Site in Rock Island.

HOMEBUYERS PROGRAM GRANT (Project Now)
Rescheduled presentation until the next City Council meeting to be held on December 6, 2004.

CITY ATTORNEY
ORDINANCE 04-38: An Ordinance Amending Ordinance No. 88-22 As Amended by Ordinance 98-41, Relating to the Establishment of an Enterprise Zone in the City of East Moline, Illinois, Moline, Illinois, Silvis, Illinois, Village of Milan, Illinois, and Rock Island County, Illinois, By the Addition of Approximately 2.2 Acres By the City of Moline and By Revising Section 3, Exhibits “A” And “B” To include New Territory Within The Illinois Quad City Enterprise Zone.

A motion was made by Alderman Kelley, seconded by Alderman Meredith, to waive the reading of Ordinance
04-38. Upon roll call the following voted in favor: Puentes, Moreno, Doose, Meredith, Kelley, Teague and Heiland. Motion carried.

ORDINANCE 04-39: An Ordinance of the City Council, of the City of East Moline, Illinois, Authorizing the City of East Moline Fire Department to bill Non-Residents of East Moline for services rendered by the East Moline Fire and EMS Departments.

A motion was made by Alderman Puentes, seconded by Alderman Doose, to waive the reading of Ordinance 04-39. Upon roll call the following voted in favor: Puentes, Moreno, Doose, Meredith, Kelley, Teague and Heiland. Motion carried.

ORDINANCE 04-40: An Ordinance Authorizing the Filing of a Petition for Demolition of a Garage Located at 712 25th Street, East Moline, Illinois.

A motion was made by Alderman Kelley, seconded by Alderman Doose, to waive the reading of Ordinance 04-40. Upon roll call the following voted in favor: Puentes, Moreno, Doose, Meredith, Kelley, Teague and Heiland. Motion carried.

ORDINANCE 04-41: An Ordinance Amending Section 7-9-5.2 Entitled “Refuse Containers For Three Family Residential and Commercial Refuse Generators”, of Chapter 9, Entitled “Solid Waste Regulations”, of Title 7, Entitled “Health & Sanitation”, of the City Code of the City of East Moline of 1974, And As Amended, And Further Amending Section 7-9-4.3 Entitled “Vacated Premises” of Chapter 9, Entitled “Solid Waste Regulations”, of Title 7, Entitled “Health & Sanitation”, of the City Code of the City of East Moline of 1974 And As Amended.

A motion was made by Alderman Doose, seconded by Alderman Kelley, to waive the reading of Ordinance 04-41. Upon roll call the following voted in favor: Puentes, Moreno, Doose, Meredith, Kelley, Teague and Heiland. Motion carried.

ORDINANCE 04-42: An Ordinance Authorizing and Providing for the Issuance and Sale of $1,360,000 General Obligation Refunding Alternate Bonds, Series 2004, of the City of East Moline, Rock Island County, Illinois, for the purpose of refunding $1,240,000 of the Outstanding General Obligation Alternate Bonds, Series 1997a, of the City; Providing for the Pledge Of Tax Increment Revenues From The Great River Industrial Park Redevelopment Project Area to the Payment of Principal of the Interest on the Series2004 Bonds; Providing for the Levy of a Direct Annual Tax for the Payment of Principal Of And Interest On The Series 2004 Bonds; Providing for the Execution And Delivery of an Escrow Agreement in Connection with the Refunding of the Series 1997a Bonds; Providing for the Execution and Delivery of a Continuing Disclosure Undertaking in Connection with the Series 2004 Bonds; And Concerning Related Matters.

Mr. Hughes updated the Council on the refinancing of the GRIP Bonds, was hoping for a $70,000 savings over the life of the bonds. Mr. Hughes received a quote of $54,000 after speaking with the underwriter.

A motion was made by Alderman Heiland, seconded by Alderman Moreno, to table Ordinance 04-42 until the next City Council meeting. Upon voice vote all those in attendance voted in favor. Motion carried.

A motion was made by Alderman Moreno, seconded by Alderman Kelley, to authorize the Finance Director to sell the GRIP Bonds not below $54,000. Upon roll call the following voted in favor: Puentes, Moreno, Doose, Meredith, Kelley, Teague and Heiland. Motion carried.

ORDINANCE 04-43: An Ordinance of the City Council of the City of East Moline, Illinois, providing for the addition of SB1 3B road from the service road North of Illinois Route 5 that extends Westerly from the intersection of Denhardt Road and Hubbard Road to the Municipal Street System of East Moline, Illinois.

A motion was made by Alderman Kelley, seconded by Alderman Doose, to waive the reading of Ordinance 04-43. Upon roll call the following voted in favor: Puentes, Moreno, Doose, Meredith, Kelley, Teague and Heiland. Motion carried.

RESOLUTION 04-27: A Resolution of the City Council of the City of East Moline, Illinois, authorizing the City Administrator on behalf of the City to enter into A Memorandum Of Understanding with Johnson Control, Inc. to Develop and Infrastructure Improvement and Operational Cost Savings Analysis.

A motion was made by Alderman Kelley, seconded by Alderman Doose, to adopt Resolution 04-27 as presented. Upon roll call the following voted in favor: Puentes, Moreno, Doose, Meredith, Kelley, Teague and Heiland. Motion carried

RESOLUTION 04-28: A Resolution Amending an Intergovernmental Agreement Among the City of East Moline, Moline, Silvis, The Village of Milan, and Rock Island County, Illinois, which established an Enterprise Zone Now called The “Illinois Quad Cities Enterprise Zone” By the Addition of Approximately 2.2 Acres by the City of Moline and changing the Zone Boundaries to add territory to the Illinois Quad Cities Enterprise Zone, and by authorizing the Mayor and City Clerk to execute the Amended Intergovernmental Agreement.

A motion was made by Alderman Kelley, seconded by Alderman Meredith, to approve Resolution 04-28 as presented. Upon roll call the following voted in favor: Puentes, Doose, Meredith, Kelley, Teague and Heiland. Opposed: Alderman Moreno. Motion carried. 6-1

RESOLUTION 04-29: A Resolution of the City Council of the City of East Moline, Illinois, Approving and Authorizing a Jurisdictional Transfer Agreement for the North Service Drive of Route SB1 3B Between the City of East Moline And The Illinois Department of Transportation.

A motion was made by Alderman Doose, seconded by Alderman Kelley, to approve Resolution 04-29 as presented. Upon roll call the following voted in favor: Puentes, Moreno, Doose, Meredith, Kelley, Teague and Heiland. Motion carried.

COMMITTEE-OF-THE-WHOLE (Alderman Puentes)
All items have been covered under the Consent Agenda, Ordinance or Resolution.

CITY STAFF COMMUNICATIONS
Each Department Head was given the opportunity to inform the City Council and all those present of events
going on in their Departments.

Rich Keehner: The City of East Moline will be having a visit from the Illinois Environmental Protection Agency on December 1, 2004. They will visit two of our Brownfield sites The Quarter and The GRIP.
East Moline Animal Hospital Grand Opening Ceremony will be held on November 18, 2004 at 10:00a.m. Everyone is welcome to attend.Attended a Global Economic Conference along with Jim Hughes in
San Antonio, Texas, made some great contacts for future endeavors.

Jim Hughes: Thanked Eddy Boggs for the CD Rom that he prepared for the presentation that was use at the conference.

Bruce Willemarck: The City will be closed on Thursday, November 25th and Friday November 26th for the Thanksgiving Holiday. Garbage for those two days will be picked up on Wednesday, November 24th, also that will be the last day for regular yard-waste collections.

Dean Piatt: Informed the City Council, after meeting with Attorney Phares and the Contractor from Triple R. Equipment they have attached a statement to there bid contract regarding payment of Prevailing Wages.

FIVE- MINUTE AUDIENCE PARTICPATION
Mayor Moreno gave members of the audience the opportunity to address the City Council.

Tony Banaszek 2552 7th Street East Moline, IL. – December 4th Santa’s Coming to Town, sponsored by The East Moline Main Street Association and I.H. Mississippi Valley Credit Union. Santa will greet children from 10:00a,m, until noon at the Amvets Post 145 Hall at 827 15th Avenue, also The East Moline Public Library will have a Holiday Matinee from 1:00 – 3:00p.m. A Secret Santa’s Workshop will be held on December 11th – 14th .

Mayor Moreno – A press release will be going out announcing the 3rd Annual Mayor’s Christmas Light Contest. There will be three divisions: The Most Colorful, Largest Display, and Best Neighborhood. Mayor Moreno thanked Mr. Morris for his assistance in providing rule and structure to this successful program.

Mr. Bush at the request of the Mayor gave a brief description of his paintings, as being Farm Scenes, Midwestern Landscapes, and Murals. His artwork is available on many different products, including calendars, greeting cards, and stationery.
