   MINUTES OF THE MEETING OF THE MAYOR
AND CITY COUNCIL OF THE CITY OF EAST MOLINE,
COUNTY OF ROCK ISLAND, STATE OF ILLINOIS

 JULY 7, 2008 AT 6:30P.M.

 

 

PLEDGE

Mayor Thodos led the City Council and all those present in the Pledge of Allegiance to the Flag   ROLL CALL Mayor Thodos called the meeting to order and directed City Clerk Arletta D. Holmes, to call the roll.  The following Aldermen were present:  Helen Heiland, Luis Puentes, Cheri Bustos, David Kelley, Roseann Cervantes, and Mayor Thodos.  Absent:  Aldermen Luis Moreno, and Gary Westbrook.   Mayor Thodos informed the City Council that Alderman Moreno was in Texas visiting with family, Alderman Westbrook is on the East Coast performing with his family, and City Attorney Phares is in Arizona with family.                                                 
ADDITIONS/CORRECTIONS TO AGENDA None   CITY CLERKS REPORT   City Clerk Holmes passed.  

CONSENT AGENDA

City Clerk Holmes read the Consent Agenda that included the following:

a)      Approval of the City Council Minutes of June 16, 2008
b)      Approval of the Committee-of-the-Whole Minutes of June 16, 2008
c)      Approval of Salaries in  the amount of $359,889.30
d)      Approval of Bills in the amount of $1,993,635.52   A motion was made by Alderman Puentes, seconded by Alderman Cervantes, to approve the Consent Agenda as presented.  Upon roll call, the following voted in favor:  Heiland, Puentes, Bustos, Kelley, and Cervantes.  Motion carried.  
REPORT BY THE MAYOR     
APPOINTMENT: Mayor Thodos appointed Ms. Terri VandeWiele to fill the vacancy left by Steve Dembosky on the East Moline Park Board.  The appointment will be for a term of two years.     A motion was made by Alderman Bustos, seconded by Alderman Heiland, to concur with the Mayor's appointment.  Upon roll call the following voted in favor:  Heiland, Puentes, Bustos, Kelley, and Cervantes.  Motion carried.    
Mayor Thodos reported on the special City Council meeting that was held on June 30, 2008. The purpose of the meeting was to discuss the flood and the municipal response to the flood. Much of the discussion was anticipation as to what the federal response would be.  Mayor Thodos is pleased to inform the residents that President Bush did sign the declaration on July 3, 2008.  What that does is give federal funds to the individual level.  Rock Island County is declared a disaster area.   It was the Mayor's understanding that some of the workers were in the area as early as Saturday with the declaration number and case numbers.   They began processing the many people who were affected by the flood.  Chief DeFrance has been in contact with Illinois Emergency Management Agency (IEMA).  Mayor Thodos asked that Chief DeFrance give the City Council a report on the situation.    Chief DeFrance stated that agents from the Federal Emergency Management Agency (FEMA) may be putting in a Disaster Recovery Center in the East Moline area, possibly during July 14th  through July 19th time frame.  Residents will be able to come to the Disaster Recovery Center to sign up for assistance.  More details will be released after we finalized this with Illinois Emergency Management Agency (IEMA) and FEMA.        It appears now that there are federal funds that will be coming down to the local level to each individual.  The City will find out what the requirements are as we proceed along.  The media outlets will be used to get the information out to all of the residents who are affected.  
CITY ATTORNEY Mayor Thodos presented the following Resolutions:
RESOLUTION 08-53:  A Resolution for Maintenance of Streets and Highways by Municipality under the Illinois Highways Code   A motion was made by Alderman Heiland, seconded by Alderman Puentes, to adopt Resolution 08-53 as presented.  Upon roll call the following voted in favor:  Heiland, Puentes, Bustos, Kelley, and Cervantes.  Motion carried.  
RESOLUTION 08-54:  A Resolution of the City Council of the City of East Moline, Illinois, approving the plans and cost estimate for the 2008 City – Wide Street and Alley Preservation and Resurfacing Program   A motion was made by Alderman Bustos, seconded by Alderman Cervantes, to adopt Resolution 08-54 as presented.  Upon roll call the following voted in favor:  Heiland, Puentes, Bustos, Kelley, and Cervantes.  Motion carried.   RESOLUTION 08-55:  A Resolution of the City Council of the City of East Moline, Illinois, authorizing the sale of Poppies by the Veterans of Foreign Wars Post 2056, and providing barricades at the location   A motion was made by Alderman Puentes, seconded by Alderman Cervantes, to adopt Resolution 08-55 as presented.  Upon roll call the following voted in favor:  Heiland, Puentes, Bustos, Kelley, and Cervantes.  Motion carried.   RESOLUTION 08-56A Resolutionof the City Council of the City of East Moline, Illinois, authorizing execution of an agreement for Professional Services with McClure Engineering Associates, Inc., to prepare Floating Breakwater Plans and Specifications for the Beacon Harbor Public Boat Docks   A motion was made by Alderman Bustos, seconded by Alderman Cervantes, to adopt Resolution 08-56 as presented.  Upon roll call the following voted in favor:  Heiland, Puentes, Bustos, Kelley, and Cervantes.  Motion carried.  
RESOLUTION 08-57:  A Resolution of the City Council of the City of East Moline, Illinois, authorizing the hiring of a Police Officer from the current eligibility list approved by the Fire and Police Commission, with a starting date of August 1, 2008    A motion was made by Alderman Puentes, seconded by Alderman Cervantes, to adopt Resolution 08-57 as presented.  Upon roll call the following voted in favor:  Heiland, Puentes, Bustos, Kelley, and Cervantes.  
COMMITTEE OF THE WHOLE (Alderman Westbrook) In Alderman Westbrook's absence Mayor Thodos reported there were no items for discussion.  All other items have been covered under the Consent Agenda, by Ordinance or Resolution.   Alderman Bustos requested that City Clerk Holmes place "Racer's Edge" (outdoor music events) on the agenda to be discussed at the next City Council meeting on July 21, 2008.  
CITY STAFF COMMUNICATION: Each City Staff member present was given the opportunity to inform the City Council and those present of events in their departments:     
Scott Feldt, Director of Economic Development – stated he has no report, but he is happy to be here.   Bruce Willemarck, Maintenance Services Director- reported to the City Council that he believes the City had another very successful 4th of July weekend.  East Moline is definitely the place to be on the 4th of July.  On Friday the City had the Firecracker Run, the Kiddy Run and the One Mile Run.  That evening there were the Fireworks at the Quarter.  This year the City hired a new Fireworks Company.  Mr. Willemarck believes it was the best show the City has had in a while.  The parking went smoothly and the weather cooperated.  
Tim Kammler, Director of Engineering – reported to the City Council that the Engineering Staff is working on modifications for the traffic signal on 11th Street and Avenue of the Cities.  This will provide a better flow of traffic at the time of day when parents are dropping off and picking up students at United Township High School.   This will be a very minimal cost.  The maintenance traffic program basically split the cost with the State.  Mr. Kammler believes this will be a very good modification at that intersection.   The consultant Shive-Hattery (engineering company) is doing a Pavement Condition Study throughout the City and they are making very good progress.  Shive-Hattery has about two thirds (2/3) of the City completed.      
Rich Keehner, City Administrator – thanked City staff for the fantastic job they did with the parade, fun run, and the fireworks show.  Mr. Keehner had family members from out of town and they were very complementary of the 4th of July events.   
Richard VanRaes, City Planner- reported to the City Council that on July 4th a soccer tournament was held at Northeast Park.   The participating teams represented the countries of various immigrate groups in the Quad Cities.  
Mayor Thodos – the Mayor believes that most of you are aware that we now have Cricket being played at Northeast Park in the spare soccer fields. The City has become very multicultural, especially when it comes to various sports being played in East Moline and the Quad Cities.     
Alderman Puentes – thanked Mr. Willemarck and staff for the wonderful job they did on the 4th of July.  He also thanked Bob Cervantes for a successful Firecracker Run.  The event had over 1,400 runners.  Alderman Puentes also noted the fine partnerships that have been forged over the years with the various organizations  
FIVE-MINUTE CITIZEN PARTICIPATION Mayor Thodos gave East Moline residents in the audience the opportunity to address the City Council.  
Eileen Alexander 703 18th Avenue, East Moline, IL. - Ms. Alexandergave a lengthy presentation on plans for a "Flea Market" to be held on August 2nd and 3rd, 2008,   at the former Hoffman School on 19th Street.  Ms. Alexander outlined her plans for a "homeless shelter" to be located at the former School.   Alderman Kelley stated he appreciates the Mayor being accommodating tonight, Alderman Bustos and I thought the City Council was going to have a discussion about the noise issue.  We did invite some residents who would like to express their concerns regarding this issue.   Mayor Thodos encouraged the residents to come forward to address their concerns.    
Ken Johnson 4641 19th Street, East Moline, IL. – Expressed his concern regarding the noise at the Rock Island County Fairgrounds.  Mr. Johnson stated the noise is so loud that the resident cannot open their windows or sit out in their yards, and on Sunday's the noise is totally unreasonable and he would like something done about the noise.  If the City has a noise ordinance, it should be enforced.       
Bill Vickers 602 1st Avenue, East Moline, IL. – expressed his concerns over his water issues not being addressed.  The drains need to be fixed. The water is coming up through the manhole covers.  He asked if something could be done as he feels that the City is not responding to him and other resident's requests.   Rose Jamison, 1101 20th Avenue, East Moline, IL.  Asked that the City reconsider its decision of letting the Racer's Edge have the outdoor music performances.  She expressed her opinion that the noise is unbearable and the language that is being used is inappropriate.   Alderman Bustos stated that she has spoken to Mr. Edwards regarding this issue.  
Armando Ochoa, 225 20th Street, East Moline, IL. – Expressed his disappointment with the City.   Mr. Ochoa's parent's home was defaced with graffiti. They received a letter from the City stating they had 24 hours to clean it (remove the graffiti) or they would be fined.  This is unacceptable.  His parents were victims, not the perpetrators, of the vandalism, and they should not have been treated this way.   Mayor Thodos made an announcement that the City Council will be having an Executive Closed Session to discuss the following:
Status of Union Negotiations.  
RECESS SESSION: A motion was made by Alderman Puentes, seconded by Alderman Cervantes, to recess the City Council meeting and proceed to the Committee-of-the-Whole meeting.  Upon roll call the following voted in favor:   Heiland, Puentes, Bustos, Kelley, and Cervantes.  Motion carried.  7:32p.m.

RECONVENED SESSION: A motion was made by Alderman Puentes, seconded by Alderman Heiland, to reconvene the City Council meeting.  Upon roll call the following voted in favor:  Heiland, Puentes, Bustos, Kelley and Cervantes   Motion carried.  8:52p.m.

CLOSED SESSION:
A motion was made by Alderman Puentes, seconded by Alderman Cervantes, to go into Executive Closed Session to discuss the following:  
Status of Union Negotiations.
 Upon roll call the following voted in favor:  Heiland, Puentes, Bustos, Kelley, and Cervantes.   Motion carried.   8:52p.m.  
REOPEN SESSION:  A motion was made by Alderman Puentes, seconded by Alderman Cervantes, to return to open session.  Upon roll call the following voted in favor:  Heiland, Puentes, Bustos, Kelley, and Cervantes.  Motion carried.  9:18p.m.           
Action from Closed Session. A motion was made by Alderman Puentes, seconded by Alderman Cervantes, to accept the proposed contract that was arbitrated for AFSCME, contingent upon the Commercial Diver's License (CDL) and shift differential issues.  Upon roll call the following voted in favor:  Heiland, Puentes, Bustos, Kelley, and Cervantes.  Motion carried.       A motion was made by Alderman Puentes, seconded by Alderman Cervantes, to direct City staff to work with the City Attorney to rescind Resolution 06-32.  The new resolution will set the insurance rate for exempt employees at 18%.      
ADJOURNMENT: A motion was made by Alderman Puentes, seconded by Alderman Cervantes, to adjourn the City Council meeting. Upon roll call the following voted in favor:  Heiland, Puentes, Bustos, Kelley, and Cervantes.   Motion carried.  9:20 p.m.
