MINUTES OF THE MEETING OF THE

MAYOR AND THE COMMITTEE-OF-THE-WHOLE

OF THE CITY OF EAST MOLlNE ILLINOIS
MARCH 15, 2004

 

 ROLL CALL

Mayor Moreno called the meeting to order and directed City Clerk Arletta D. Holmes to call the roll.  The following Aldermen were present:  Helen Heiland, Luis Puentes, Luis Moreno, Carol Doose, Rick Meredith, Gary Kelley and Crotis Teague.   7:06p.m. 

 

AMENDED CURFEW ORDINANCE  (Chief Freeman)

The U. S. Court of Appeals of the Seventh Circuit on 1/22/04, issued an opinion, which struck down an Indiana curfew statute on the basis that it was overly broad and, therefore, it was unconstitutional since if failed to protect the First Amendment rights of those charged.

 

Recommendation:

The revision of the present Curfew Ordinance to meet the requirements of the U. S. Court of Appeals, in anticipation of a challenge to the City's current Curfew Ordinance. 

 

Budget Impact:  None

 

Attorney Phares gave background information on the Indiana Court Case that struck down the Indiana Curfew Ordinance.  By deleting the present Section 6-6-1 entitled "Curfew Hours" and by adopting the following language change (See Attachment) we will be in compliance.

 

 

A motion was made by Alderman Moreno, seconded by Alderman Meredith, to concur with the recommendation as presented.  Upon voice vote all those in attendance voted in favor.  Motion carried.

 

PARKING, 1600 BLOCK 5TH STREET  (Chief Freeman)

Alderman Heiland was contacted about changing parking signs on 5th Street between 16th and 17th Avenues.  The signs are currently for two-hour time limit parking on the west side.  The east side is unlimited.  The change would make it no parking at all on the west side.

 

Recommendation:  Change signs to no parking anytime.  Budget Impact:  Cost of signs.

 

A motion was made by Alderman Heiland, seconded by Alderman Teague, to concur with the recommendation as presented.  Upon roll call the following voted in favor:  Kelley, Teague, Heiland, Puentes. Moreno, Doose and Meredith.  Motion carried.

 

 

ADJOURNMENT

A motion was made by Alderman Kelley, seconded by Alderman Doose, to adjourn the meeting.  Upon roll call the following voted in favor:  Kelley, Teague, Heiland, Puentes, Moreno, Doose and Meredith.   Motion carried.    7:12p.m.
