MINUTES OF THE MEETING OF THE

MAYOR AND THE COMMITTEE-OF-THE-WHOLE

OF THE CITY OF EAST MOLlNE ILLINOIS
FEBRUARY 2, 2004

 

ROLL CALL

Mayor Moreno called the meeting to order and directed City Clerk Arletta D. Holmes to call the roll.  The following Aldermen were present:  Helen Heiland, Luis Puentes, Luis Moreno, Carol Doose, Rick Meredith, Gary Kelley and Crotis Teague.   7:06p.m. 

 

ENGINEERING SELECTION  (Dean Piatt)

After having reviewed Statement of Qualifications from various engineering firms, H R Green meets our needs.  We can reduce our utility expense and get better plant performance and control by installing VFD (Variable Frequency Drives) on our aeration and return activated sludge motors.

 

Recommendation:  Approve H R Green to draw up the specifications and obtain bids for project. 

Budget Impact:  Proposed Engineering services are $9,012.00 and are available in the most recent Water Bond.

 

A motion was made by Alderman Puentes, seconded by Alderman Moreno, to concur with the recommendation as presented.  Upon voice vote all those in attendance voted in favor.  Motion carried.

 

HAZARDOUS MATERIAL PERMIT  (Chief DeFrance)

On October 17, 1986, the President signed into law the Superfund Amendments and Reauthorization Act of 1986 (SARA).  This act amended the Comprehensive Environmental Response, Compensation and Liability Act of 1980 (CERCLA), commonly known as "Superfund".  Included under Title III of SARA, was a free standing law, the Emergency Planning and Community Right-to-Know Act of 1986 (EPCRA).  Its purpose is to encourage and support emergency planning efforts at State and local levels and provide the public and local governments with information concerning chemical hazards present in the community.

 

Recommendation:  Approve the Amendment to the International Fire Code. 

 

Budget Impact:  It is difficult to estimate the quantity of hazardous materials in the City at this time.  The inspection and permit program will further identify the quantity.  Based on the Tier II information currently on file with the City, permit revenue could cost up to $15,000. 

 

A motion was made by Alderman Puentes, seconded by Alderman Teague, to concur with the recommendation and pass on to the full City Council for consideration.  Upon voice vote all those in attendance voted in favor.  Motion carried.

 

SPECIAL USE ORDINANCE  (Phares/Van Raes)

The East Moline Zoning Ordinance does not contain a procedure for a property owner to apply for a Special Use Permit.  The ability to provide for special uses in appropriate circumstances is beneficial to Economic Development within the City, while improving certain conditions for special use.

 

Mr. Van Raes gave a summary of Ordinance 04-02 and Ordinance 04-03; Special Uses language is in accordance with State Statute.  The Plan Commission is the body to hear testimony and The Plan Commission will issue a written report for recommendations.  Ordinance 04-03 Light Industrial Use; adds to the Ordinance for Special Use in Light Industrial.

 

Recommendation:  Adopt the proposed special use provisions.  Budget Impact:  None

 

A motion was made by Alderman Moreno, seconded by Alderman Meredith, to concur the recommendation to proceed with the Special Use Ordinances 04-03 & 04-03 as presented.  Upon roll call all those in attendance voted in favor.  Motion carried.

 

AMENDMENT TO WEAPONS ORDINANCE  (Chief Freeman)

Over the past year the Police Department has handled several cases where damage was caused by the use of paint ball guns.  The current ordinance on the discharge of weapons does not address this type of weapon.  The Police Department is requesting that the current language be changed to help enforce the ordinance.

  

Recommendation:  Re-write Paragraph (A) of Ordinance 6-3-9 (See Attachment). 

Budget Impact:  None

 

A motion was made by Alderman Heiland, seconded by Alderman Moreno, to concur with the recommendation as presented.  Upon voice vote all those presented voted in favor.  Motion carried.

 

ADJOURNMENT

A motion was made by Alderman Moreno, seconded by Alderman Kelley, to adjourn the meeting.  Upon roll call the following voted in favor:  Moreno, Doose, Meredith, Kelley, Teague, Heiland and Puentes.  Motion carried.    7:40 p.m.
